National and provincial departments are required to report the legal costs incurred during disciplinary processes for the 2023/24 and 2024/25 financial years by the close of business on 16 May 2025.
As outlined in DPSA Circular No. 16 of 2025, this reporting requirement is in line with the resolutions of the Public Service Coordinating Bargaining Council (PSCBC), including the PSCBC Resolution 1 of 2003 Disciplinary Code and Procedures and other sectors.
“The heads of departments are hereby required to report to the DPSA the costs incurred for legal representation used in disciplinary processes, including section 188A inquiries conducted by arbitrators within their departments,” the Circular states.
The Circular includes a reporting template to assist departments in compiling their submissions. The template requires departments to provide not only cost figures but also the reasons for the use of legal services in each disciplinary case.
