The Minister for Public Service and Administration, Inkosi Mzamo Buthelezi, has welcomed the recent Labour Court judgement regarding the contempt of court application filed by the National Education, Health and Allied Workers’ Union (NEHAWU). This ruling clears the Department of Public Service and Administration (DPSA) of the allegations made by NEHAWU, the Minister explained.
The Acting Judge of the Labour Court, Ndivhuho Tshiseyhe, dismissed NEHAWU’s application with costs, concluding that the respondents complied with the court order. The court found that NEHAWU failed to establish a case for contempt, characterising their claims as egregious and lacking in merit, as they did not convincingly demonstrate non-compliance with the court order.
The court acknowledged the Minister’s positive engagement with NEHAWU in accordance with the settlement agreement. While the majority of proposals tabled by NEHAWU were duly responded to, some could not be favourably considered due to financial constraints.
In a media statement, Minister Buthelezi expressed gratitude for the court’s careful consideration of these matters. He reaffirmed the DPSA’s commitment to fostering harmonious relationships with all stakeholders and encouraged all parties to view this judgement as an opportunity to move forward collaboratively.
“NEHAWU’s decision to seek court intervention reflects their desire to resolve issues constructively and to enhance the relationship. Additionally, it highlights the importance of transparency and mutual respect in the process. This collaboration is essential for strengthening the public service for the benefit of all employees and the citizens they serve”, said Minister Inkosi Buthelezi.
The Minister reiterated his commitment to transparency and fairness in dealing with all labour relations issues.
“I believe that by working together, the outstanding issues can be addressed and a more equitable environment for public servants can be created,” he added.
